Electronic signature and legal recognition

It is important to note that maintaining a safety log is a legal requirement. The validity of digital versions has raised legal questions, particularly regarding log signatures during audits and inspections.

In 2012, the Central Safety Commission (CCS) ruled on the legal validity of digital safety logs, provided they meet the requirements of Article R143-44 of the Construction and Housing Code (CCH) and pursuant to the following articles:

• 1316-3 of the Civil Code: "A document in electronic form has the same evidentiary value as a document on paper."
• 1316-4 of the Civil Code: "The reliability of this process is presumed, until proven otherwise, when the electronic signature is created, the identity of the signatory is ensured, and the integrity of the act is guaranteed, under conditions set by the Council of State."
