What is the DUERP within the Deemply ecosystem?

The Occupational Risk Assessment Document (DUERP), often referred to as the DU or DUER, is the central tool for managing and preventing risks in the workplace. What is the DUERP?

To begin with, it is essential to know that the DUERP is mandatory for all companies as soon as an employee is hired at the establishment. This means that if you are a business owner with at least one employee, you are required to have an Occupational Risk Assessment Document and keep it up to date.

The legal requirement

In the DUERP, the employer is required to record the results of the risk assessment regarding the health and safety of their employees. This document helps identify potential exposure to risks and indicates the preventive measures that can be implemented. Risk assessment is mandatory for the employer and falls under their responsibility.

In the event of an inspection by the competent authorities, the head of the establishment must justify that they are implementing all necessary elements to ensure a healthy and safe working environment for all their employees. This obligation is set out in the Labor Code.

The DUERP: a pillar of the 9 general principles of prevention

The risk analysis that forms part of the DUERP is based on the 9 general principles of prevention. These principles were established to guide employers in managing risks and hazards at work:

  1. Avoid risks by implementing actions to avoid risks by eliminating the hazard or exposure to the hazard.
  2. Assess risks by measuring the level of exposure to the hazard and its significance, in order to prioritize the actions to be taken for prevention purposes.
  3. Combat risks at the source by integrating prevention as early as possible. This can be done by considering the design of the workplace, operating procedures, or equipment.
  4. Adapt work to the individual by taking everyone's needs into account.
  5. Take technological developments into account through technical and organizational adaptation.
  6. Replace the hazard by replacing a dangerous process or product with one that is less dangerous to reduce overall risk.
  7. Prevention planning by integrating organization, working conditions, social relations, the environment, and technology.
  8. Prioritizing collective protective measures and, if necessary, the use of personal protective equipment.
  9. Communicating appropriate instructions to employees through training and information so they are aware of the risks and the measures to take to avoid them.

How to draft the DUERP and who can access it?

Creating the DUERP

The creation of this regulatory document is structured and must follow these steps:

  • Step 1: Prepare the risk assessment by gathering all necessary information regarding the premises, work phases, activities, and all company processes.
  • Step 2: Identify the risks. In this step, you must examine all workstations and ask questions such as: What hazards exist at this station? Which employees are exposed to the risks? Under what working conditions are they exposed to these risks?
  • Step 3: Classify the risks. Here, you must prioritize the risks based on the various scoring criteria established beforehand. These criteria can be specific to your company, but generally, they include a concept of severity and a concept of probability. These two criteria help determine the level of danger and exposure.
  • Step 4: Propose an action plan. For each identified risk, you must propose concrete measures to reduce or eliminate it. These recommended preventive measures can then be selected for implementation within the company.

The DUERP must be kept by the employer for 40 years. This period begins from the date the document is created.

A new DUERP should be created—meaning all these steps must be repeated—whenever changes in organization or working conditions occur within the establishment.

Who can access the DUERP?

Depending on the number of employees in the company, the single document must be accessible to the following people:

  • Current employees or those who have left the company; the DUERP allows them to understand the risks associated with their position.
  • Members of the CSE (Social and Economic Committee) of the establishment. As a reminder, this is mandatory once a company has more than 11 employees. To learn more, visit this site.
  • Occupational health and prevention services, which are essential partners in risk management.
  • Labor inspection agents.
  • Carsat (Retirement and Occupational Health Insurance Fund) agents.
  • All agents from professional health, safety, and working conditions organizations.
  • For radiation protection inspectors.

What are the potential penalties for non-compliance?

If the employer fails to keep this regulated document up to date or does not have it available on-site, they are liable for a 5th-class fine, namely :

  • Up to €1,500 for an individual, which can increase to €3,000 in the event of a repeat offense.
  • For a legal entity, the fine is €7,500 for a first offense and can reach €15,000 if the employer is a repeat offender.
  • If the document is not made available to the Social and Economic Committee (CSE), the employer commits an obstruction offense. Penalties for this type of offense can reach up to €3,750 in fines and 1 year of imprisonment.
